Can Sony Legally do this??

ive just purchased a pre-owned copy of DCUO thinking that the free 30 day code will have been used, but expecting to be allowed to then go online and pay for a monthly subscription. 

 

now ive found out that once an activation code has been used, its locked to that account, therefore making pre-owned copys useless.

 

Sony have not made this clear at all judging from other posts and a quick google. the cover simply says "30 day subscription included"

 

SURELY there must be some law where they have to say it cannot be resold etc??

 

I understand all the problems with pre-owned games and it taking the money away from Sony and putting it in the hands of the shops. thats why they have subsriptions, to keep getting paid each month. but to do that AND make it impossible to re-sell the game. its just greedy.

 

if ANY game should be traded in and sold on, it should be this one, as they will get at least another months subscription for every pre-owned copy that is sold. all they have done is screwed themselves out of making more money! 

 

this game is already alienating a good % of buyers because of the monthly fees, and now theyve alienated even more.

 

i will be taking this game back for a refund and will NEVER purchase this game new. i want to play it but i havent been this pee'd off in a long time. Sony can FO!

I'm not sure if you could trade this game back in or not, someone should no, I'm not sure about this type of game

All pre owned games sellers/buyers are currently hated buy all games publishers.

EA
SOE (sony online entertainment still Independant from SCEE but part of SCE WW)
Ubisoft
THQ

All now have voucher codes.
and No buying second hand does not include any extras provided buy the publisher if the first buyer does not include them.
This also includes Rentals not just SHM, Online activation codes wont be included buy some rental companies as they dont include the manual.
Pre owned sellers should realy indicate whats missing, but wont as it effects sales.

XBOX games used to have free LIVE voucher in them this WAS never valid in second hand games that were traded in.

No publisher has ever supported SHM and NONE ever will.

If you got it from game im not sure if there no quibal exchange applys to trade in games.

Hmm ... I would say Sony can legally allow this to happen, but whether the retailer can is another matter. "/

 

I've always taken the view that the retailer has a legal obligation to inform you of any required details before you make the purchase. So, if they never informed you that the 30-day trial would no longer be valid, then that breaks The Sale of Goods Act so you should be able to get a refund. I think? xD :smileytongue:

 

EDIT: Taken from The Sales of Goods Act: ""fit for purpose - which means it should perform the function you bought it to do". Well, you bought it under the impression you could use the 30-day trial, you can't, so that's not fit for purpose. "/

 

Think I may have looked a little too far into this lol, but yeah, you should be able to take it back. :smileyhappy:

thanks guys

i understand that (grangers games) should not have sold this game pre-owned so will be taking it back to explain.

but what i feel sony should have done is let people know that the game is NOT trade-able, has no re-sale value or cannot be lent to a friend etc. all it says is it inculdes a free 30 day trial code. nothing indicates that the game is locked to your account.
not only did they not advertise as such, but theyve made it very difficult for people to even find out that this is the case.

i understand that trade-ins take away money from the developers. but what would they rather have, my £10 a month from a game no one uses any more, or nothing??

The issue here then is that the 30 day trial code is also an activation code for the game, which is locked to a psn account once activated and therefore makes it impossible to trade? I wouldn't expect to get the 30 day trial if i bought the game pre-owned but i would expect to be able to play the game! (by purchasing a subscription from the ps store)
I would have thought Sony should make this clear but don't think they have a legal obligation to do so.

Lol no the issue is people did not read the box or do any research and tryed to get it cheaper.
Online only, subscription required.
RED ONLINE bar on box not BLUE shows that there is no single player or no offline content.
There is no seperation of universes every user has to pay for that months content. The price at new retail includes the 1st months fee when you pay. It does not say "free" it says "included".

consdering selling second games is legal to do and is coverd by trading standards . then you should be warned that game cannot be sold 2nd hand. does it state anywhere that you cannot play the game if bought 2nd hand . you could potentially take this quite far . but if you cant be arsed get a refund at the shop and let them deal with trying to give it back to sony.

Can you not just go into the PSN store and buy a subscription and tie it too your PSN account? The game(disk) is not tied to PSN accounts. Its just the free trial code. So just go into the store, buy a monthly subscription and off you go. Its what my friend did when he bought a second hand copy.

 

He also knew, that if he bought a second hand copy that the 30 trial would of been used up. Its comon sense isnt it?
