Returning headset

Hello, I have a question for anyone in the retail or legal profession! I bought the tritton ax720 headset through amazon marketplace via a 3rd part gameseek. On amazon the headset was advertised as the new version of the headset which has 7.1 virtual surround sound and rotating ear cups along with some other improvements over the older 5.1 version. When the headset arrived I unpacked it and set it up with my ps3 after which I noticed that the headset was infact the older version, gutted! I emailed gameseek who apologised for the mistake but they don't stock the newer version and said they would send out parcel force to collect the item and then refund. So all in all this is fine but I've unboxed the headset, does this mean they can refuse to refund me? I have tried to box the headset back up as best I can but I ripped some of the plastic packaging that contained the cables. Do you have to send items back as unopened? it's not clear on their returns policy on the page.

No it's fine. It's their fault, not yours. I wouldn't worry about it. They didn't state that you have to send it back unpackaged or anything so it's fine.

I've opened up a DDR mat for the Nintendo Wii once from GAME, and it wasn't clear on their website that it would only work with the old Wii with the Gamecube ports on it, so I had to send it back, partly unpackaged, and it took a while to refund me, but they refunded me still.
