Have they not just shot themselves in the foot though? showing even without SOPA and PIPA they can still shut down and control what we see? They don't need to add anything if they already have the power to shut down sites suspected of piracy.

Yes, I thought about that before I posted my comment. They can indeed already shut down sites, seize domains etc. and do so to quite a large extent already. But I still think this is likely to be considered by most people as evidence that there is a problem rather than the counter-argument you raise.

 

Maybe the New Zealand angle on this one is intended to illustrate the global reach needed to address the problem? Or perhaps the alleged $500m loss is the only real blunt weapon? I'm only guessing, but the timing does seem too convenient to be pure coincidence.

 

And I see that the predictable retaliation is already underway.

All they had to do was move to a server in another country and they should have gone live in that same country, America cannot do a thing to them then.

According to the BBC site the US have seized 18 domains in Hong Kong, executed search warrants in 9 countries and seized $50m worth of assets. But they needed court orders to do so, and presumably the agreement of the countries in question (obviously unless a high profile terrorist suspect is being assassinated).

 

With SOPA I guess they would be able to bypass the latter inconveniences.

Nah they dont need a court order, They have to get a court order within an acceptable ammount of time or give you back the domain.

 

The FBI has done it at the request of record companies to innocent sites already. It takes them months to actually bother getting a court order if you fight them, most wont fight.

 

There is a high profile case on the internet of a guy who did fight, it took him a few months, and at the end of it the FBI agreed he had done nothing wrong, and that he shouldnt have had his domain siezed, they gave him back his domain and were unable to show him any court order allowing them to sieze it.

 

They are not even legally required to show you a court order.

 

SOPA will mean that they will have to do even less for you.
