Hello all,

I run a site geared towards game developers ( http://www.gamefromscratch.com ) and with the SDK release was considering creating a detailed tutorial on creating a game from scratch using the Playstation Suite SDK.  Problem is, the EULA really makes it sound like this is impossible.  Frankly it sounds like talking about the SDK at all publically is against the EULA, which seems extremely odd given it is now an *open* beta.

So I was hoping for some clarification if creating such tutorials is permited or not?

That's interesting. Hopefully Sony just forgot to swap in the open beta Eula.

Indeed that is something I've noticed myself studying the PSS Eula...

Sony seems to make it near to impossible to talk about Developments in Public... which sadly, given the nature of Indie-Projects in general, is a bad move to make...

But given Sonys reaction of finally providing a affordable SDK after years of Indie Developer cries, I hope they will reconsider that part of the Eula and update it appropriately.

I'm certainly no lawyer, but I'd read, "You shall not release or disclose to any third party Your Work or other product which is developed through use of the PS Suite SDK without SCE’s prior written consent (including by electronic means such as email)." As meaning that if you use the SDK without Sony's written consent (ie: haven't agreed to the EULA and downloaded it from Sony), you can't distribute your works as if you had.  I'd think if they meant it the way some of you are reading it, the clause about prior written consent would have been attatched to the first part of the sentence rather than where it is.

I'd say it's pretty obvious that their intention isn't to keep anyone from collaborating because the next section explicitly addresses that, "...you may disclose and/or provide Your Work (along with any part of PS Suite SDK in source code format provided by SCE hereunder) to any third parties for the purpose of development and/or promotion of applications for PlayStation®Suite of you and/or such third parties."

I hope we get an official answer soon.

Actually it's this line that I have the most issue, in regards to being able to create a tutorial or wiki for example:

You shall hold the PS Suite SDK itself and any other information provided, from time to time, to you from SCE or SCE’s affiliated companies designated as “Confidential” ("Confidential Information") in confidence, using reasonable care to maintain the confidentiality of the Confidential Information. You agree not to use, except for the purposes of this Agreement, any and all of the Confidential Information.
