Having those terms in fine print contravenes the Trade Practices Act. Sony is in breach of the law. So why don't you start whining about the law now smokey?

Could you please show us where in The Trade Practices act it says this? as On 1 January 2011 the Trade Practices Act 1974 was renamed the Competition and Consumer Act 2010

How can I tell if a term in my contract is unfair?

The following questions can help you recognise a potentially unfair term, but it is important to note that the final decision on whether a term is unfair can only be made by a court.

  • Does the term cause a significant imbalance between your rights and obligations and those of the business?
    • Does the business have more power than you? Are you penalised if the contract is terminated (through no fault of your own) but the business is not? Can the business change important terms of the contract without asking you? Can only the business decide if the contract has been breached?
  • Is the term reasonably necessary to protect the legitimate interests of the business?
    • While it may appear to you that a term is unfair, the business may have a genuine commercial reason for including it. However it is up to the business to prove to the court that it has a good reason.
  • Would the term cause you detriment (financial or non-financial) if the business tried to enforce it?
    • Would you lose money or suffer inconvenience, delay or distress if the term was enforced?
  • How transparent is the term? 
    • Can you understand what the term says? Is the term presented clearly and expressed in reasonably plain language? Or is it hidden in fine print or written in complex technical language?
  • The fairness of a term must be considered in the context of the contract as a whole. 
    • For example, what is unfair in one context might not be unfair in another. You might have extra rights or benefits in the contract that balance the potential unfairness of a term.

Music Unlimited login server is down without warning yet again.

 

I'm OK as my PSP was already online before the server went down, but my wife is spitting nails because she can't login with her separate account until the server comes back up, and she want to listen to a certain cd NOW!!!

 

Yesterday she asked me to download it from Amazon, and I pointed out that there's no point as she can listen to it on Music Unlimited on her PC, just the same as if she was listening to the mp3 of it on her PC. Now I've got to buy it for her anyway, so she doesn't have to rely on the Sony system actually being up and running to hear it. That's kind of undermining the whole point of having the Music Unlimited system.

 

C'mon Sony, you've got to get this working more reliably, else subscribers will revert to the traditional local downloads approach, and cancel their accounts.

 

(Meanwhile I see that the CD she wants to hear is available to play for free on Grooveshark - whose servers I have never seen unavailable).

Looking back at my own posts, these are the dates where the system has been down -

 

31 March

7 April

10 April

21 April

 

That's about 20% of the time.

 

Four times in three weeks is very poor IMHO.  They should add a day's free use onto all subscriptions each time it goes down.

 

I rang support and they were unaware of the problem.  They checked and agreed that it's down, and suggested trying again later...

For Music Unlimited, everything appears to be working at last. All functions are re-enabled (eg being able to add to "My Library" and use of the playlist functions) and my account shows two months' free subscription. The first month is doubtless to cover the payment already made for a period which couldn't be used while the network was down, and the second month is a "welcome back" bonus.

Just checked. Aweseome. I've actually been able to use all the functionality just not on a pc. Using it right now actually. Listening to some jaaazz.

I had exactly the Same problem using internet Explorer. Installed Google Chrome. Problem gone.
