Gamesharing is illegal, right?

114 Replies 4,690 Views Created 04-08-2008

I found out about this like yesterday... There is supposed to be some sort of "system" which has Sony's blessing and it's supposed to be perfectly legal too. But I won't buy it. There was this kid, "nikezu", yesterday whom added me to his friends list and asked for a "sharing" my psn games for him. And I asked what's it about, never heard of it. He told that I was supposed to give my email I use to login and password for PSN. Then the bells rung in my head extremely loudly and told him to f**k off. But this kid started claiming that it's perfectly legal thing and that it has SONY'S APROVAL! I was like lol, it's not, read the PSN license agreement. And then he blocked me... It was weird enought that it was worth looking into with google...

Somebody should state it from Sony. Since there are punch of 10 year kids claiming it's legal when it is not. They refer in to this http://www.wired.com/gaming/gamingreviews/news/2006/10/71982

When it clearly contradicts with the PSN User Agreement and other licenses.

http://www.us.playstation.com/support/useragreements

And what's the thing with the web?

People have made numerous threads like these:

http://forums.n4g.com/m_178005/mpage_1/printable.htm

http://www.psxextremeforums.com/playstation-3/8137-official-psn-gamesharing-thread-split-trade-share...

Where they do this "sharing". It's just plain simple illegal and it's supposed to be common sense that you will not give away your passwords for any service. What's wrong with the web these days?

If this post is annoying or something then mods are free to remove it but my thing here is to talk about this "sharing", not to "share" anything to anyone.

I am gettig confuzed. While the PS3 and PSN terms of use clearly say that this kind of activity is prophitted there is article like this on PS3 customer support:

I purchased some downloadable game content on the PLAYSTATION®Network. Part of the product descripti...

Answer:

This means that the content that you purchased may be used by other users on an activated PLAYSTATION 3 after you downloaded the content onto your PLAYSTATION 3.   Some content may require the user to have a PLAYSTATION Network account, and other content may require you to have additional game content that may be sold separately.  For example, you may need to purchase a full game in order to use the character that you purchased on the PLAYSTATION Network for the game.

Please review the use restrictions associated with the content you purchased.  The content may be played on up to 5 activated PLAYSTATION 3's at any one time.

I picked that up from: http://ps3mods.blogspot.com/2007/05/playstation-store-game-sharing.html

This is getting now really really really weird...

I am starting to think that somebody has f***ed up at Sony. If this is legal why there are no way to ensure on what activated devices are and how they are activated and what for. If "sharing" would be legal there should be way to ensure that nobody will play "a prank" to other. Why this "feature"is not advertised anywhere. There are huge risks also in this thing.

3. Even though our friendly neighborhood lawyers try to check everything we do here with a fine-toothed comb, we're not saying we're flawless. Sorry to have to say it, but the only promise we can make to you is that this site is totally cool and loads of fun! Anything you read, hear, look at, or use, you're doing so at your own risk. We assume no liability or responsibility for errors or omissions on this site.

6. This may sound familiar, but it's important, so we're going to rephrase it. Anything on this site--pictures, drawings, text, games, anything--is either our property or the property of someone who gave us the permission to use it. IT'S NOT PUBLIC DOMAIN, AND IT'S DEFINITELY NOT YOURS. Don't use any of it for anything other than personal entertainment, unless we say you can (and we probably won't). If you do, you're probably violating at least one law, and since we told you here, we won't feel bad about coming after you.

7. On the same note, there are plenty of trademarks, logos, and service marks on this site that belong to us or someone who said it's cool for us to use them. So hands off! (That's from our legal guys.) They also say if you fool around with any of these trademarks, they or the owner of the mark or some other prosecutor who they inform will come after you.

So, that's not everything but I kind of found it amusing that within real legal licenses was this practial joke one. I wouldn't take that seriously, no way in hell.

Edirol 2:

Some germanese guys on this forum have writen that this site's admins got this nailed with following words:

"Game sharing is in violation of the ToS for the PSN. As such, discussion of game sharing is not permitted here. Please keep this in mind for the future. Thank you."

and...

"Please note that discussion of game sharing is not permitted on these forums. Thank you."

This practicly means that starting "game sharing" thread here where the point is to share games around is not permitted. As it is illegal. I guess we can talk about the subject when ever or not it is illegal or not.

Yeah its legal, but can become messy, as if you, your brother, your girlf and her dad all buy a game then you will need your brother, your girlf and her dads account on your machine to play those games.

What I did with some old school friends is create a "whip account"

We all put a fiver in whip. We all have "whip account" on our machine. We all share the content. Peasy.

It's completely legal to share games.

However, who you share it to is up to you. All the usual rules apply; don't give your password and username to anyone you don't know. etc

What makes you guys think it's legal? I'd be interested to know about that. we just got moderator to express it's illegal.

I've got this thing like that if you own two Playstation 3s then you could "activate" them both from account settings to play games you have purhaced from PSN. It's not completely legal to share games you have bought from PSN Store with just anyone, including your friends. Just like it's not completely legal to buy records from iTunes and then burn and rip them just so that you could share them away.

PSP has functionality for this, it's legal on PSP somehow. But not on PS3.

Like I said, the topic is all a little grey, I mean if say you and a sibling or a flatmate had a ps3 each, I'm guessing it'd be okay to share considering you both live within the same household. It's like buying a dvd movie, it's okay to make a backup copy of the disc incase it breaks, but it's not okay to share those backup copies with people you don't live in the same household with, I mean what happens isn't wholly traceable, but at the end of the day the liscence also requires you to use your common sense to make a judgement of what's okay and what isn't. :)

I guess sony tell us that we can share the game up to 5 PS3s for no reason then. Really, why would they condone illegal activity? Think about it.

And it's meant for you YOU to login on someone elses ps3 and download it.. not give THEM your details.

Simple answer is if you couldn't "game share" sony can and do lock certain games to people's PSN ID therefore making it impossible to gameshare, also anyone on these forums gives out thier PSN ID creditionals to any random person im sorry deserves to be hacked. I have a close friends account PSN ID creditionals on my machine and he has mine we "game share" all the time though we have both discussed buying our own content for our own use this is because we believe sony will put a stop to this trend.

Gamesharing is NOT allowed, people say you can share with up to 5 people. People who stop to think will probobly realise that someone's PS3 might break somewhere down the line and might get a new one, hence they are now allowed to redownload that game to THEIR new PS3, and if they get another PS3, they can do it to that too.

Of course it is illegal, hence the reason why they updated their Copyright Protection on games with v2.4.

However, I do believe this is the case for multiple PS3's, I think multiple users are allowed to use the same game content if they are on the one PS3 as the new Copyright Protection enables this.

Depends what you mean by illegal.

If you mean that it's against the rules of PSN and could lead to people being banned / having content removed / having civil action taken against them, probably.  I don't care enough to check as I will pay for goods if they are worth doing so (very little of that on PSN!).

If you mean a criminal offence (as I suspect most people here do), then no.  If anyone wants to offer an offence, I'd be very curious what they come up with.

I thought this was pretty obvious?

1) You buy the rights to play the game on your account
2) It can be played by anyone that uses your console
3) If your PS3 goes ***** up and you get a new one, you can download it onto that.

The 5 console 'feature' is just to handle DRM in the case that your machine buggers up. Gamesharing itself is illegal.

Gamesharing is illegal, but the 5 activated ps3 business is not in case your system breaks. I have read cases of people having used the feature for 5 different machines that were in their household and when 1 broke they had to get sony to register the broken one as deactivated so that the replacement could be used as 1 of the 5 machines with the same games on them. It's stupid to give you're details to someone you don't know but the feature is useful so that you can play a game you have paid for on more than one machine that you may own. It's the same as buying a disc based game and playing it in more than 1 console. That said, it does give you the ability to gameshare, but as someone said just because you can doesn't mean it's legal. It's not going to stop me sharing with my brother-in-law though lol
