I would be back in Comet and demanding an exchange, nevermind ringing Sony for a 40GB PS3. Just to set a few matters straight, it is Sony's responsibility to replace the Playstation 3, not Comet. Sony have exclusive rights to repair or replace all consoles unless the consumer purchased an extended warranty. This is Sony's choice not Comet's. If the item was took back within 7 days, then they are entitled to a refund/exchange depending on which part of Comet they bought it from. :Thumbs:

omg sony costomer service is the best it only took me 2 mins to get through to someone and they asked me what my problem was and they are sending me a new ps3!!! i thought they were brill!! and they are brill :smileyvery-happy: :smileyvery-happy: :Thumbs:

they are good yeah like when they helped me with my psp online number but i wasnt happy with the ps3 service however for all i know it could have been down to a misunderstanding between the courier and sony. and yes its very easy to get through to people i find

I'm sorry mate but I don't know where you got that information but it's completely wrong! Here are your rights taken directly from the Consumer Direct website (The Office of Fair Trading).

Your rights

If you have bought an electrical or gas appliance, it must be of satisfactory quality, fit for its purpose and as described.

When an item doesn’t meet some or all of these conditions:

If you have only used it a few times or haven’t had a reasonable opportunity to check them, you are probably entitled to a refund for a fault or poor description, or alternatively you may request a replacement.

If the fault is only minor and can easily be put right, it is reasonable to accept a repair. This won’t stop you claiming a replacement or refund if the repair turns out to be unsatisfactory.

If you have used it more than a few times or have had a reasonable opportunity to check them, you are probably still entitled to a repair or replacement. A repair should be carried out within a reasonable period of time and without causing you significant inconvenience. Any repair should restore goods to a satisfactory condition. If this does not happen, you are entitled to a replacement or compensation. This could be a sum of money or the cost of hiring a temporary replacement, or perhaps the loan of a replacement.
If the goods cannot be replaced or repaired economically, you are entitled to a refund. The trader may make a reduction from the price you paid to allow for the use you have had from the goods.

If the goods have damaged anything else or you are out of pocket in any other way, you may be entitled to compensation over and above the price of the original goods.

The trader must sort out your problem, not the manufacturer.

Remember, if you are entitled to a refund, replacement, repair or compensation, it is the trader who must sort out your problem. The trader cannot tell you to go back to the manufacturer.

I got the information from myself, because I work at the Comet head office :Thumbs: I have access to all the returns policies and procedures for every product the company sells. I am aware about the sales act and consumers rights, but regardless Sony deal with the warranty of the Playstation, the same as Apple deal with the warranty on there products. It is there policy, not Comet's. Though as I said in my first post, if it was under 7 days, that would be different - as the original poster said, he bought it well in advance of christmas, fore going his 7 day returns policy.

You're talking rubbish mate! You're basically saying that if someone buys a PS3 from Comet they don't have any consumer rights. If a PS3 that was purchased 11 months ago suddenly developed a fault, I could walk into the store I purchased it from and as long as I can provide proof of purchase and get a replacement whether it be Comet, GAME, PC World, Currys, or anywhere else.

I'm sick of stores trying to bypass the consumer rights act and fobbing their customers off so that they don't have to handle the issue!

I can't believe you're still in denial even though I posted the legal consumer rights that apply to every individual in the UK. I even put a link to the government's website so you could see for yourself!

I am thinking WHY are Sony so helpful? Are the covering up on something? Whey are they so quick to replace all these faulty consoles that seem to be in circulation? It seems they were on standby for this... I'm a Sony fan but worried by all this carry on, as I too have had my 60gig PS3 replaced from my outlet with a 40gig + store vouchers for the exact same reason... am slightly worried that this one will also go bust on me too...:Scared:
