Try re-patching the game with a fresh delete and reinstall of the game data. 

Delete the patch and the install in the game data utility folder and run the game with a fresh update should cure the problem.

i need to try that as i have been having that water crash all week and its bloody annoying

Check the Skyrim boards. The fix for this issue has been known since Bethesda released the patch. You can also read the official fix here : http://forums.bethsoft.com/topic/1364560-game-freeze-after-going-underwater/

I had this for ages, got infuriating after a while. I tried deleting the game data and re-installing the latest update and now it seems to be working fine. I can swim around in water for hours without any further screen freezes.

yuup works for me now too, just wish i didn't waste 30 hours of gameplay collecting books for Urag the librarian thinking i would actually get something, only found out yesterday the books are unlimited.
