Apparently this is already the case on US accounts. If you don't agree to the new terms then you can't take your PS3 online. Not sure whats happening in England or the rest of E.U.

Don't think I'm going to agree. I recently had a large transaction attempted on the card that used to be on my PS3 account. The only other place I've used it is linked to my paypal were they couldn't have got the details. So I'd quite like to talk to sony about this and definitely not agree to anything saying I wont take legal action!

I think the article is overstating things with the word ban which suggests you did something wrong. Its common for Sony to put up new terms every few months and if you don't agree to them then you can't access the PSN anymore and this is no different.
Although the clause to get out of any legel liability for the security breach will be open to discussion I'm sure.

Yes & No mate.
In agreeing to the ToS you waive your right to take Sony to Court (as a group or indiviually) for any reason associated to the Playstation Network. ANY reason.
By agreeing to the ToS you agree that all disputes will be handled by a mediator designated by SCE, in a place of SCEs choosing and settled in accordance with SCEs wishes.
Now, there is an opt out clause buried later in Section 15 of the ToS, where any PSN user can write listing their choice to opt out of that clause. You can still agree to the ToS and Opt Out while retaining your rights and PSN access.
And NO, this clause will not be added to the EU ToS. Sony may try but it will have to be removed, as no document in the EU region can waive your right to a court hearing.
Just remember, this ToS is for US PSN account holders, not EU or other regions.
