can someone help me and explain if there is a way to play the guitar hero drum set with rock band 1 thanks

Due to the fact that rock band came out in Aus after rock band 2 came out in the US they never released the patch to fix it on RB.
Best way is to buy either RB 2 or RB3 and port the RB content over. That way you get all but a few copywriten songs all able to be played on drums.

I'd probably suggest giving the developers a call for that.
They'd be able to tell you the in's and outs of that game - what you can and can't do.
